I think you can only use "apply" when you already have text typed and selected. Otherwise, use "Set as default".

Seems like the problem is solved however if anyone else is interested... last week we put a video tutorial on Circular Text and Touched on Kerning. This process will work on any path or shape that you convert to a path.
